Sample: Mutual Agreement to

Terminate Contract of Employment

Pursuant to Section 212 of The Education Act, 1995, it is hereby mutually agreed that the contract of

employment between (A)________________________________________________________ and the (B)______

______________________________________________________ School Division No. _______

is hereby terminated effective (C)_________________ subject to the following conditions:

1. Should (A) ________________________________________ become ill prior to (a)___________________,

the termination of the contract of employment shall be deemed to be pursuant to (b) Article 7.5.6.3

of the Provincial Collective Bargaining Agreement and the effective date of the termination shall be

altered in accordance with 7.5.6.3.

AND/OR

2. That (A) ___________________________________________ shall receive the retirement (c)

________________________________________________________________________

(gratuity or incentive as per board policy or as per the local collective agreement).

AND/OR

3. That the (B) __________________________________ School Division No. ____ shall offer (A) _________

___________________________

a temporary contract for the period (d) _________________ to ___________________ , or

ii) a replacement contract for the academic year 20__________ to 20__________ , or

iii) a continuing contract for the period commencing (f) ________________.

The contract of employment is subject to the terms of The Education Act, 1995 and forms part of this

agreement.

AND

4. That neither party to this agreement will have any future claims upon the other nor any future

obligations to the other beyond those contained within this agreement.
