Preparing for the Event:
You may only purchase alcoholic liquor from the licensed Kansas Retailer who also possesses a Federal Wholesale Liquor Dealer
permit or from the Kansas Farm Winery named on your application. (K.A.R. 14-23-8)
If the event location is on the premise of a liquor licensee, the licensee must de-license their location for the date(s) and time(s) and
time(s) of the event by completing and submitting the Request for the Public Function (ABC-825) to the ABC at least 10 days prior to
the event.
During the Event
You must prominently display at the entrance to the permitted premises all of the following:
the temporary permit
o
the name of the agent for the organization who is in charge; or, the name of the individual applicant or another person designated by
o
the individual
a diagram of the premises covered by the temporary permit, clearly showing the boundaries of the premises, entrances to and exits
o
from the premises, and the area in which the service of alcoholic liquor will be served (K.A.R. 14-23-5)
The permit holder or designated agent(s) must be present at the event at all times.
The permit holder cannot employ or use any person who:
is under 18 years of age to serve liquor,
o
is under the age of 21 years to mix or dispense drinks containing alcoholic liquor,
o
is under the age of 21 years and not supervised by the permit holder or an employee how is at least 21 years of age,
o
has been convicted of a felony or of any crime involving a morals charge to dispense, mix or serve alcoholic liquor or,
o
who has been convicted within the previous two years of a violation of any intoxicating liquor laws of Kansas, or of any other state or
o
the United States to dispense, mix or serve alcoholic liquor.
The permit holder or designated agent(s) must admit any law enforcement officer to the premises covered by the temporary permit. (K.A.R.
14-23-5(c)(3).
The permit holder cannot sell a drink to any person for less than the acquisition cost of that drink.
The permit holder must charge the same price for the same drink all day.
The permit holder shall not sell alcoholic liquor for removal from or consumption off of the event premise, except that liquor may be removed to
a drinking establishment that has extended its premises into the Special Event* area in accordance with K.S.A 41-2645.
Individuals may be allowed to bring bottles of alcoholic liquor on to permitted premises provided each individual removes the bottles when
departing the event premises.
On-Premise and Special Event temporary permit holders are required to collect the 10% Liquor Drink Tax.
After the Event:
Retain your purchase and sales receipts for one(1) year.
Liquor Drink Tax:

The liquor drink tax collected at your event is due by the 25
day of the following month in which it was held. You must file your
liquor drink tax return (LD-1) and remit payment by the due date. Failure to file your liquor drink tax return and remit payment may
result in being fined by the Director of the Alcoholic Beverage Control. (K.S.A. 79-41a07)
