10- DAY NOTICE FOR MATERIAL NON-COMPLIANCE
A.R.S. § 33-1368(A)
USE:
When the tenant has committed a material noncompliance with the lease or rental
agreement, including falsification of the information provided on the rental application.
WHEN:
The DAY AFTER the landlord/owner receives notice of the alleged noncompliance. The
tenant has ten CALENDAR days from the date of this notice to remedy the violation.
Falsification of the number of the occupants or the number of pets in the dwelling unit.
The listed income as reported on the application.
An incorrect or false social security number
Falsely reported employment.
Falsification of information relating to the following constitutes a material breach that cannot be
remedied:
Falsification of information concerning criminal records.
In the case of falsification of information and if a payment is made by the tenant of all overdue charges
within the 10-day period of the notice, the rental agreement is deemed reinstated.
EFFECTIVE DATES OF NOTICE, A.R.S. § 33-1313
CERTIFIED MAIL:
When the notice is sent by certified mail, it becomes effective on the date
the notice is actually received by the tenant or five days after the date the
notice is mailed, whichever occurs first. A 10-day notice sent by certified
mail becomes a 15-day notice (10+5). The forcible detainer complaint

PERSONAL DELIVERY:
The hand-delivered notice becomes effective when handed to the tenant.

The forcible detainer complaint can be filed with the court on the 11
day.
Any step reasonably calculated to inform a person (whether or not the other actually comes to know of it)
may be considered proper notice.
Notices taped to the tenant’s door are not considered proper notice.
For the purposes of this section “days” are calendar days.
When filing a forcible detainer action, please bring a copy of your notice to the court.
