ORDER FOR CAPIAS
ON THE _______ day of _____________________________, 20 _____, came on to be considered a
Motion for Contempt filed herein by Movant which complains of Respondent.
IT APPEARS that Respondent was duly served on the ________ day of _____________________,
2 0 _____, with a show cause order wherein Respondent was ordered to appear before this Court on the
________ day of ________________________, 20 _____, at ___________ o’clock ________M. The Court
b eing in session on that date, called the case for hearing and the Respondent wholly failed to appear as
o rdered. Whereupon Respondent’s name was duly called three times at the Court room door, to which call
R espondent has failed to respond. Based upon Respondent’s failure to appear as ordered:
IT IS ORDERED, ADJUDGED AND DECREED that a Capias shall forthwith issue to any Sheriff or
o ther proper Peace Officer within the State of Texas, and said officer is hereby ordered to:
ARREST THE PERSON OF RESPONDENT, _______________________________________, and
bring the Respondent to the DALLAS COUNTY JAIL, to await the availability of the Court, and detain in
t he custody of the Sheriff until Respondent shall be duly discharged by the Court; or if Respondent is found
a nd arrested outside of Dallas County and the Respondent may be brought to the DALLAS COUNTY JAIL
and so detained until the Respondent may be duly discharged by the Court.
IT IS FURTHER ORDERED, that the Sheriff shall release Respondent prior to the Respondent’s
d ischarge by the Court only upon the Respondent’s posting of a cash bond of $ ____________________
payable to the OBLIGEE and conditioned on Respondent’s promise to appear in court for hearing on the
merits as required by this court WITHOUT FURTHER PERSONAL SERVICE OR NOTICE.
THE DALLAS COUNTY SHERIFF IS FURTHER ORDERED to notify the Deputy District Clerk
a ssigned to this Court on or before the first working day after the arrest, who is HEREBY ORDERED to
notify the Court as soon as Court is in session, if and when, the Respondent is in the custody of the Sheriff or
h as been released on bond.
