PAVILION RENTAL/USE PERMIT
The CITY OF CALLISBURG, TEXAS hereinafter called the “City”, and _______________________________,
hereinafter called the “Lessee”, do hereby enter into this agreement for use of the Parkhill Park Pavilion belonging
to the City under the following terms and conditions:

For the above stated consideration, the “Lessee” does reserve from the “City” for the period of time shown above,
the pavilion located in Parkhill Park, and hereby agrees to the following terms and conditions:
1. The “Lessee” does agree that it will indemnify and hold harmless the City from any and all acts of negligence
of the “City” or of the “Lessee”, its representatives, employees and guests, pertaining to indemnity for any
and all personal injuries, property damage or other events arising from the use of the Pavilion.
2. The “Lessee” is solely responsible for staffing its operations, programs, activities, events, or use subject to
prior approval by the “City”, and the “Lessee” does ensure the “City” that proper supervision will be provided
at the “Lessee’s” expense.
3. The “Lessee” does agree to use the facilities only for the intent and purpose as so stated in this agreement,
which is subject to all applicable laws and ordinances, as well as “City” departmental policies, rules and
regulations therefore.
4. The “Lessee” shall be fully responsible for all clean up and janitorial services. Failure of the “Lessee” to
provide such services and return the said premises to the “City” in the condition in which it was received,
subject to reasonable wear and tear (determined by the “City”), may result in charging to the “Lessee” such
expenses that may be incurred in all clean up and repair required and arising from the program, activity, event
or use by the “Lessee.”
5. The “Lessee” expressly understands and agrees that no alcoholic beverages will be provided, consumed or
used in the Pavilion and Parkhill Park.
6. The “City” reserves the sole right to preempt any scheduled program, activity, event or otherwise if need be,
provided advance notice is given the “Lessee.”
This agreement constitutes the entire agreement of the parties involved and may not be amended in writing.
